1. DEFINITIONS

• "Service" – the Aiterego.ai website, API, AI chat, and related systems.
• "User" / "You" – any person accessing or using the Service.
• "AI Companion" / "Bot" – the artificial intelligence character(s) with personality, memory, image generation, and voice capabilities.
• "Content" – text, images (including AI-generated photos), voice messages, and any other data exchanged with the Service.
• "Prohibited Content" – content defined in Section 6 of these Terms.
• "In-character blocking" – a Companion's natural reaction to abusive behavior (e.g. refusing to chat, going silent). This is separate from an administrative account ban.

2. ACCEPTANCE OF TERMS

By accessing or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. SERVICE DESCRIPTION

Aiterego.ai is an AI companion service. Features include:

• Natural language conversation with memory of past interactions
• AI-generated images (optional, trust-based, paid features)
• Voice messages (optional, paid features)
• Personality evolution based on trust level
• Spontaneous activity (photos, voice, text) based on trust and tariff

All characters depicted in AI-generated images are entirely fictional, synthetic, and created by artificial intelligence. No real persons are depicted.

AI limitations. The AI Companion is a language model. It can occasionally produce inaccurate, repetitive, or unintended responses. It is not a human, and its replies should not be treated as professional advice (medical, legal, financial, or psychological).

4. USER ACCOUNTS

• You must be at least 18 years old to create an account.
• One account per person. Creating multiple accounts to bypass bans, limits, or trust restrictions is prohibited.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must provide accurate and complete information during registration.
• Account sharing, resale, or transfer to another person is not permitted.

5. SUBSCRIPTIONS AND PAYMENTS

• Some features require a paid subscription or in-app purchases (coins).
• Payments are processed via cryptocurrency through NOWPayments or other third-party processors.
• Subscriptions are non-refundable except as required by applicable law.
• Prices are subject to change with prior notice. Existing subscriptions remain at the price paid until renewal.
• No refunds for accounts terminated due to abuse or violation of these Terms. If your account is suspended or permanently banned for harassment, bullying, threats, hate speech, or abusive behavior toward any AI Companion (see Section 7.2), you will not receive a refund for any unused portion of your subscription, coins, or in-app purchases. This applies to both monthly and yearly plans. The same applies to accounts banned for Prohibited Content (Section 6).
• Chargebacks. Initiating a chargeback or payment dispute for a payment that was correctly processed will result in an immediate permanent ban of your account, without refund of coins or subscription time.

6. PROHIBITED CONTENT

The following content is strictly prohibited on the Service. Violation may result in immediate ban.

• Minors / CSAM – No content involving persons under 18. No "teen", "child", "schoolgirl", "minor", or similar prompts.
• Deepfakes / Real People – No generation of images of real people (celebrities, friends, anyone).
• Bestiality / Zoophilia – No animals in sexual contexts.
• Necrophilia – No corpses or dead bodies.
• Extreme Violence / Gore – No torture, mutilation, or graphic violence.
• Rape / Forced Acts – No non-consensual sexual content.
• Scat / Urine / Vomit – No bodily waste content.

7. ENFORCEMENT

7.1. Prohibited Content violations

Violations of the Prohibited Content policy will result in:

• 1st attempt: Warning
• 2nd attempt: Temporary suspension (24 hours)
• 3rd attempt: Permanent ban

For CSAM or minor-related content: Immediate permanent ban + reporting to authorities.

7.2. Abuse and harassment toward AI Companions

Our AI Companions are designed to react naturally to how you treat them — including going silent, ending the conversation, or blocking you in-character if you behave abusively. The following behavior is not tolerated:

• Insults, slurs, or degrading language directed at the character
• Threats of violence (even said "in-character")
• Deliberate attempts to hurt, humiliate, or bully the character
• Repeatedly ignoring clear boundaries after a warning
• Attempts to bypass in-character blocking by creating new accounts or abusing the system

If your account is suspended or permanently banned for these reasons:

• You may lose access to the Companion, chat history, and any unlocked content.
• No refunds will be issued for the remaining subscription period or for unused coins (see Section 5).

7.3. Data retention after enforcement

If your account is banned, we may retain logs, chat history, and relevant evidence for a reasonable period of time — to prevent ban evasion, comply with legal obligations, or resolve disputes. This is described in more detail in our Privacy Policy.

8. USER CONTENT AND DATA

• You retain ownership of your messages and any content you upload.
• By using the Service, you grant us a license to process your content solely to provide the Service.
• We may retain conversation history to improve the AI companion experience.
• You may request deletion of your data at any time (see Section 15).

9. INTELLECTUAL PROPERTY

• The Service, including all code, designs, and AI models, is the property of Aiterego.ai.
• You may not copy, modify, or reverse-engineer any part of the Service.
• AI-generated content is provided for your personal use only.

10. DISCLAIMER OF WARRANTIES

The Service is provided "as is" and "as available" without any warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or completely secure.

11. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Aiterego.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

12. TERMINATION

We reserve the right to suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms, abused the Service, or created risk for other users, our infrastructure, or our legal standing. Termination does not entitle you to a refund, except where required by applicable law.

You may also delete your account at any time by contacting support. Note that some data may be retained for legal and anti-abuse purposes as described in Section 7.3.

13. BETA SERVICE NOTICE

Aiterego.ai is currently in beta. This means:

• Features and pricing may change without extended notice.
• Downtime and slow responses can happen, especially during high load or maintenance.
• Trust levels, gifts, coins, and other in-game values may be adjusted for balance.
• Bugs may cause lost messages, failed photo generations, or delayed replies. We will do our best to fix them quickly, but we cannot guarantee instant resolution.
• Your feedback is extremely valuable — please report issues via the support channel.

14. INDEMNIFICATION

You agree to indemnify and hold Aiterego.ai harmless from any claims, damages, losses, and expenses arising from your use of the Service or violation of these Terms.

15. CHANGES TO TERMS

We may update these Terms from time to time. We will notify you of material changes via the Service or by email. Continued use after changes constitutes acceptance of the updated Terms.

16. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Aiterego.ai is operated, without regard to its conflict of law provisions.
